John Stuart had served in the 25th Foot and the 52nd Foot before transferring to the 9th as lieutenant-colonel on 29 May 1806. He commanded the 1st Battalion in Ireland before they sailed to Portugal in July 1808. At the battle of Roliça, on 17 Aug, the 9th was in support of the 29th Worcestershire Regiment which was overwhelmed by superior French troops. The 9th came up to support them and in the fighting Lieutenant-Colonel John Stuart was killed.
The monument to his memory in Canterbury Cathedral is a relief statue of the dying Colonel Stuart supported by Britannia, and a lengthy inscription beneath that indicates that the monument was paid for by his fellow officers.
